General Terms and Conditions
Welcome to Go Sharing
These are the general terms and conditions (“Terms”) of Go Sharing. Go Sharing offers the GO Sharing App (“App”) which makes it easy for users to reserve and unlock shared vehicles (“Services”). To learn more about how this works – or if the Customer wants to get started right away – download the App or visit Go Sharing’s Website www.go-sharing.com.
Go Sharing offers to provide these Services subject to the Customer’s acceptance of these Terms. Go Sharing may change these Terms at any time. The Customer agrees that the latest version of these Terms will always apply to the Services.
What is Go Sharing?
Go Sharing Mobilite Hizmetleri ve Tic. A.Ş., trading under the name GO Sharing, registered office Gursel Mah. Imrahor Cad. No:29 Premier Kampus Ofis B Blok No:6 Kagithane 34400 and registered in the Chamber of Commerce trade registry with the number 239215-5.
Who is the customer? A consumer and/or legal entity who uses our App and/or simply visits our website. In these Terms, we also refer to that person as (Customer).
Article 1- DEFINITIONS
The terms used in these Terms have the meanings defined below:
(a) Go Sharing: Go Sharing Mobilite Hizmetleri ve Tic. A.Ş,
(b) Service: The service of reservation and rental of Go Sharing’s electric scooters/vehicles by the Customer, the details of which are specified in this Agreement and its annexes,
(c) App: GO Sharing App that enables unlocking of electric scooters/vehicles and provides up-to-date information about the Service,
(d) General Terms and Conditions: Conditions for the use of Go Sharing’s electric scooter(s) subject to this Agreement,
(e) Security and Cookie Policy: Go Sharing’s privacy and cookie policy at www.go-sharing.com, which is attached to and made an integral part of this Agreement in the App,
(f) Customer/ User: The consumer who receives the services offered by Go Sharing through the Application and is a party to this Agreement,
(g) Preliminary Information Form: Law No. 6502 on the Protection of Consumers and Distance Contracts Regulation (Official Gazette: 27.11.2014/29188).
(h) Service Area: An area determined by GO Sharing where the Use of the Vehicle can be initiated and terminated. The most current version of the Service Area can be found on the digital map in the App or on the Website.
(ı) Customer Service: GO Share Customer Service. Please see our Website for more up-to-date contact information.
(i) Agreement: This Go Sharing Distance Sales Agreement,
(j) Rental Agreement: The contract created for each Use.
(k) Other costs: The list of rates for the Use of our Services available on the Website. The list of other costs includes the rates for the Use of the Vehicles and the amounts of fines for breach of the Terms.
(l) Basic Rules: The rules that apply to the Use of our Services available on the Website. Click to go to the ground rules page.
(m) Website: GO Sharing Website: www.go-sharing.com.
(n) Law: Law on Consumer Protection
Other definitions starting with a capital letter may also be given in the provisions themselves.
Article 2- SUBJECT OF THE CONTRACT
2.1.The subject of this Agreement is the agreement that the Customer has ordered to rent an electric scooter/vehicle belonging to Go Sharing and has received the Service provided by Go Sharing in the Application, the qualifications, information and price of which are specified below. This Agreement regulates the mutual rights and obligations of the Parties in accordance with the provisions of the Law and the Distance Contracts Regulation.
2.2. This Agreement has been prepared in accordance with the Law, Distance Contracts Regulation and other legislation. The Customer and Go Sharing accept, declare and undertake that they are aware of the responsibilities and obligations arising from this Agreement, laws and regulations and other legislation.
Article 3- BASIC QUALITY AND SCOPE OF SERVICE
3.1. Under this Agreement, Go Sharing will provide the Customer with electric scooter/vehicle rental services limited to the following only:
- Renting Go Sharing’s electric scooters/vehicles by making a reservation through the App,
- Making the rented electric scooters/vehicles available to the Customer for a maximum period of 7 (seven) days,
iii.Information about the use of electric scooters/vehicles through the app,
- Hotline service by phone/app for electric scooters/vehicles
- ……
3.2. The Service is only a service for the rental of electronic scooters/vehicles through the Application and does not include any services other than the Services set out in this Agreement and the Terms and Conditions.
Information on the use of the Service is provided below.
3.3. Account
3.3.1. You can benefit from our Services by logging in through the Application. In doing so, we request that all of your personal and payment data requested (your explicit consent statement and the data received in accordance with the information text prepared within the scope of the Personal Data Protection Law No. 6698 (“Law”)) be provided and the verification procedure is followed (for payment method and driver’s license). Once all necessary data has been provided and the verification procedure has been completed, your account will be activated (Account).
3.3.2. GO Sharing may at any time ask you to perform the verification procedure again. GO Sharing reserves the right to decide which verification procedure is preferred in the actual situation. In any case, GO Sharing has the right to block your Account if it deems it necessary, which in any case appears to involve your failure to comply with the request.
3.3.3.3. The Client is personally responsible for the accuracy, protection, access and use of his/her Account. If the Client suspects that a third party is using your Account (illegally), please report this immediately via support@go-sharing.com.
3.3.4. The use of the Account is strictly personal. Login details are not provided to a third party, allowing other persons to access the Client’s Account. In the event of any breach of this condition, we may impose a contractual penalty for the Client (as set out in other costs), without prejudice to our right to claim additional compensation.
3.3.5. The Client declares that the personal data used by him/her when creating his/her account is correct. If Go Sharing suspects that the (personal) data provided by the Customer is invalid or if the Customer’s Use of the Services is not in accordance with these Terms, the Agreement and/or applicable laws and regulations, Go Sharing may suspend, terminate or otherwise restrict the Customer’s Use of the Services (including the Use itself).
3.4. Kullanım
3.4.1. The Client may reserve and actually Use (Use) shared vehicles (Vehicles) through the App. The Use of the Vehicles is subject to the Basic Rules. [and country-specific laws and regulations. GO Sharing may impose additional conditions on the Use of a specific Vehicle and/or its Use in a specific Service Area (pursuant to Law No. 6502 on Consumer Protection). These conditions are usually shown in the App.
3.4.2. The reservation of the Vehicle (and thus the Rental Contract) is only made after confirmation by GO Sharing in the App. A successful reservation does not guarantee the availability of a (functioning) Vehicle.
3.4.3. Use of the Vehicle may only begin and end in the Service Area designated for this purpose in the App. Use will not end until the Application notifies the Customer that the Use has successfully ended
3.4.4. The use of the Vehicles may be limited in time. The maximum period of Use of the Vehicle is specified in the Application and in any case is no longer than 7 (seven) days, unless GO Sharing gives written consent for a different maximum period.
3.4.5. The Customer is entitled to rent as many vehicles as he/she wishes and 7 (seven) days is the maximum period of use of the rented Vehicle. The Customer shall use the rented Vehicle within this period in accordance with the Terms and Conditions without causing any damage.
3.4.6. The service provided to the Customer is a 24/7 Car rental service and he/she will be able to rent a car through the Application at any time regardless of the time and day. Go Sharing may send a password / ask security questions at the time of booking to verify the Customer’s identity.
3.5. Discount packages and driving time
3.5.1. Usage credit (such as driving time or discount packages) (Credit) is subject to a limited validity period.
3.5.2. The purchase of the Credit shall take place at the moment the Credit appears in the Account and the validity period is, in principle, limited to one (1) year from the date of issue, unless expressly stated otherwise.
3.5.3. In case of issuance of Credits within the scope of promotional activities, the validity period is in principle limited to 30 days, unless expressly stated otherwise.
Article 4- PAYMENT INFORMATION FOR THE SERVICE SUBJECT TO THE CONTRACT
4.1. The price and payment (collection) information for the Service purchased by the Customer is as follows:

4.2. In the event that the Bank/financial institution to which the credit card or debit card belongs does not pay the Service fee to Go Sharing or requests a refund for any reason after the service has been provided, Go Sharing shall decide to terminate the performance of the service.
4.3. In the event that the Customer pays the service fee by credit card or debit card, all facilities provided by these cards are payment options provided directly by the card issuer.
Article 5- PAYMENT- INVOICE
5.1. Invoice Delivery: It will be sent as an e-invoice to the e-mail address notified by the Client to Go Sharing.
5.2. Rate, payment and debt collection
5.2.1. GO Sharing determines the cost of Usage based on applicable Other costs (which can be found on Our Website) and actual Usage. If you have a subscription or discount code, this will be taken into account.
5.2.2. Before the Use starts, we agree on how payment will be made. The App allows various payment methods. Is a security deposit applicable? Then you authorize GO Sharing to collect the security deposit (as previously notified).
5.2.3. If payment of the due fees fails for any reason, GO Sharing will request the Client to pay the amount due anyway. If the Customer fails to pay the amount due within the specified period, the debt will be rolled over and subsequent debt collection costs and other charges will be charged to the Customer and/or deducted from any deposit.
5.2.4. GO Sharing will require payment of outstanding debts in order for the Services to be available again.
5.3. Third party billing
5.3.1. If the Client uses payment data of another person (legal entity, company or individual) when registering in the Application, the Client must have obtained prior consent from the person to whom the payment data was provided.
5.3.2. GO Sharing is authorized to contact directly the person whose payment data was provided by the Client in order to verify that the Client has indeed obtained the necessary consent.
5.3.3. If it appears that any consent referred to in clause 6.2.1 has not been obtained, the Client must pay any outstanding debts owed to GO Sharing on his account and shall compensate GO Sharing for any losses incurred.
5.3.4. If GO Sharing has verified the confirmation of the payment data provider referred to in clause 6.2.1, the party other than the Client shall be jointly and severally responsible and liable for all obligations of the Client towards GO Sharing arising from these Terms and/or the Agreement.
Article 6- DECLARATIONS AND COMMITMENTS OF THE PARTIES
6.1. CUSTOMER DECLARATIONS AND COMMITMENTS
6.1.1. The Client declares that he/she has read the preliminary information provided by Go Sharing regarding the basic characteristics, subject matter, start and end date, usage, amount, payment method and presentation of the Service in the Application and has given the necessary confirmation electronically.
6.1.2. Since the Customer has approved this Agreement and the Preliminary Information Form electronically; the Customer confirms that he/she has received the necessary information correctly and completely. The name, title, address and contract information that must be given to the Customer by Go Sharing before the distance contract, the basic features of the ordered service, the subject of the service, the start and end date of the service, its use, the total price of the service including taxes, information regarding the payment and performance of the service.
6.1.3. The Customer may communicate any claims, demands and complaints regarding the service subject to the contract to Go Sharing.
6.1.4. If the Customer is not the owner of the credit card used to pay for the service subject to the Agreement, he/she accepts that he/she is exclusively responsible for the requests from the credit card holder.
6.1.5.Customer Responsibility and GO Sharing
- The Customer is liable for all direct and indirect damages incurred during or by reason of the Use of the Vehicle and/or the Services, unless the Customer can prove that the damage cannot be attributed to it.
- In any event, damage is attributable to the Customer as a user if it is caused by the following circumstances:
. If there is a breach of the Agreement and/or these Terms; and
. If there is gross negligence, a deliberate act or willful misconduct. ‘
- The term ‘damage’ includes, but is not limited to, consequential damages such as, without limitation, expert costs, relocation expenses, depreciation, costs arising from lost profits and administrative costs.
- The Customer is responsible for the consequences of traffic accidents or accidents occurring with a Vehicle. The Customer must pay all resulting fines, levies and costs and indemnify GO Sharing against claims by third parties.
- The Customer is liable for damages and/or injuries caused to third parties or third party property during the Use of the Vehicle. The Customer indemnifies GO Sharing for any and all consequential and third party claims arising from such damage and/or injury.
- Damages to third parties may be covered by GO Sharing’s third party liability insurance, except for the excess stated in other prices. If the damage is covered by third party liability insurance, the Customer shall, without prejudice to the other provisions of this paragraph, be liable to indemnify GO Sharing for the excess of the insurance amount.
- If damage occurs due to the actions of the Client which causes the insurance company not to pay, the Client shall be liable to GO Sharing for compensation for the resulting damage.
- GO Sharing is not liable for any damages unless there is a willful act or willful misconduct of GO Sharing (set out above).
6.1.6. Penalties
6.1.6.1. By accepting the Terms or by using the Application, the Customer also agrees that Go Sharing may collect the following penalty terms from the Customer in case the Customer violates the Terms and/or the applicable legislation. The Customer acknowledges, declares and undertakes that he/she is aware of this situation; that he/she will act in accordance with the provisions of these Terms and applicable laws; otherwise, the following penalties and penal clause amounts will be collected by Go Sharing in whole or in part through the Customer’s payment methods defined in the Application; in case of failure to collect, he/she will pay these amounts with Go Sharing’s first request; otherwise, he/she accepts, declares and undertakes that he/she knows that Go Sharing will demand and collect the penal clause amount by taking legal action in addition to the right to compensation for the damage arising from the violation of the Terms:
- Cleaning fee for extra dirty Vehicles is 250 TL,
- Using vehicles with someone else’s account 5000 TL,
- Driving without a license 15.000 TL,
- Parking outside the designated areas 250 TL,
- Violation of parking rules or incorrect parking (traffic fine + towing fee + parking fee) + 250 TL,
- Illegal movement of a parked device 250 TL,
- Parking in an inaccessible and/or private property area 500 TL,
- Damages caused to the Vehicle due to improper use of 5,000 TL and above (If over 5000 TL, it will be determined according to Go Sharing’s own maintenance report),
- Failure to report damage to the device after driving (amount to be determined in Go Sharing’s own maintenance report + 500 TL),
- Vehicles that are stolen or lost 100.000 TL,
- Use of a device under the influence of a substance 10,000 TL,
- Bridge use and crossing between the European and Anatolian sides (Bridge fees + 500 TL),
- Suspension of the Customer’s use of the Services in case of non-payment of penalties,
- All traffic fines incurred/received by Go Sharing due to Customer fault or negligence.
6.1.6.2. If the Customer’s act and/or omission results in more than one penalty, each penalty may be accrued separately by Go Sharing.
6.1.6.3. In the event of a conflict between other provisions of the Terms and this “Penalties” provision, the “Penalties” provision shall apply. If you believe that an erroneous determination has been made, please send an e-mail to Support@go-sharing.nl with a justified and explanatory text.
Article 7- DECLARATIONS AND COMMITMENTS OF GO SHARING
7.1. Go Sharing undertakes that the service subject to the Agreement will be provided in accordance with the Consumer Legislation and the relevant legislation. Go Sharing is responsible for providing the Service subject to this Agreement to the Customer in a complete and error-free manner.
7.2. Go Sharing is obliged to notify the Customer immediately or after 1 (one) day at the latest in case of force majeure or if it becomes impossible to provide the Service subject to the Agreement. In the event that the provision of the service becomes impossible or cannot be provided due to force majeure, if any fee related to the rental has been collected from the Customer;
. Payments made by wire transfer shall be paid to the Customer in cash and in lump sum within 10 (ten) days.
. For payments made by the Customer by credit card, the service fee will be returned to the relevant bank within 7 (seven) days following the cancellation of the reservation.
7.3. The Customer accepts, declares and undertakes that Go Sharing cannot hold Go Sharing responsible for any delays that may occur in the transfer of the amount returned to the credit card by Go Sharing to the Customer’s account by the bank.
7.4. The Customer is aware that an internet connection is required to provide the rental service through the Application. The Client agrees that Go Sharing shall not be held liable in any way if the rental does not take place due to the internet connection or the Client’s phone. In such a case, all fees paid by the Client for the Service will be refunded to the Client without any deduction within fourteen days.
Article 8- EXCEPTION TO THE RİGHT OF WITHDRAWAL
The service to be provided by Go Sharing under this Agreement is an “Exception to the Right of Withdrawal” pursuant to Article 15.1.g. of the Regulation on Distance Contracts numbered 29188 published in the Official Gazette dated November 27, 2014. This article includes “contracts for accommodation, transportation of goods, car rental, food and beverage supply and the use of leisure time for entertainment or recreation purposes, which must be made on a specific date or period“. Therefore, the Customer will not be able to exercise the right of withdrawal.
Article 9- TERM AND TERMINATION
9.1. The term of this Agreement and the Service continues from the date of rental until the Customer terminates the rental. In any case, it expires no more than 7 (seven) days after the rental date. In the event of termination of the rental agreement or expiration of the term, the Agreement shall terminate automatically without any notice or warning.
9.2. At the end of the term, the Customer may not make any claims to Go Sharing for any service or price for not utilizing the Service at all or at an adequate level.
9.3. The Customer may terminate the Agreement with GO Sharing in writing (including by e-mail) without any notice period. Termination does not release the Customer from the obligation to pay outstanding payments.
9.4. GO Sharing may terminate the Agreement in case the Client breaches the Agreement and damages the Vehicles.
Article 10- OTHER PROVISIONS
10.1. GO Sharing processes personal data in order to provide the Services to the Client. GO Sharing is happy to inform the Customer about this in its privacy policy and personal data disclosure statement.
10.2. GO Sharing expressly reserves the right to make changes to the Terms and other charges. Any changes will be published in the App and/or on the Website. Any Use of the Services after such notice shall be deemed to be (evidence of) the Customer’s acceptance of this Agreement.
10.3. These Terms, the Agreement and the rights arising from the Agreement shall be governed by Turkish law.
10.4. According to the Law, the Customer has the right to apply to consumer arbitration committees or consumer courts in districts and provinces according to the monetary limits announced in the Official Gazette every year.
Explicit Consent Regarding the Processing of Personal Data
I have read and approve the Go Sharing Clarification Text on Personal Data prepared within the scope of the Law on the Protection of Personal Data sent to me by Go Sharing. I expressly consent (consent/approval) for my personal data that I have provided to Go Sharing to be received, taken over, recorded by automatic/non-automatic methods, stored in written/digital archives in Turkey and/or abroad, stored, used, updated, updated, changed, rearranged, reorganized, classified, transferred domestically or abroad and processed in accordance with the law by taking the necessary measures to protect its confidentiality and complying with the legal principles regarding the processing of personal data. I have been informed and enlightened about my legal rights by Go Sharing, its partners, business partners, successors and/or third parties to be determined by them.
